Title: Cruising Wagon Title Issues
Post by: FlyerPinto on January 09, 2008, 01:48:47 PM
Well folks, the battle for the title for the yellow 77 Cruising Wagon continues. The investigator for the Clerk of Courts brought me his report today. It states no previous owners who had titled the vehicle could be found and that the search had been conducted in Ohio, Illinois, Georgia and Alabama. He explained how I had purchased the car and basically explained the situation. Now all I need to do is have my attorney file a "friendly lawsuit" against the clerk of courts here in the county. The suit will order the clerk to issue a letter to the title department directing them to give me a title for said vehicle, and that will be all she wrote. However, I still don't know what it will cost to file the suit. If I could do it myself I would but otherwise I will be counting on an attorney, usually not a cheap way to go. But, all things being equal, I should very shortly have a legal title for the Pinto, which I will almost certainly sell right away.

here in wa i had a 72 pinto wagon i lost the title and the prevues owner had moved. it was also out of the computer. so i wrote out a statement that stated i owned the car free and clear. had it notarized and took it to the dol and they did a standard vin inspection and gave me a title.

u have the car possession 9/10 of the law! there is one other easy way to do it that i know of take recites showing that u have money into the car and lean file it if know one show up in 30 day to pay u what u have into it. its yours

Of course, we are talking about Ohio here, and they don't make anything easy. But the investigator was nice enough to come to my home and my office, so I can't complain. At least I didn't have to tow the car out to the BMV. The companies that advertise in Hemmings are a good source, unless you live in Ohio. I contacted them and they state in their paperwork that Ohio is one of the states (there were a handful of others) where they do not do business. So to court we go! O-H-I-O! After the BCS debacle I guess it isn't the time for this particular cheer, huh?

The title battle continues, but the tide has turned in my favor! Tomorrow I will make a deposit with my attorney, who will take all of my papers and file a lawsuit against the clerk of courts. The clerk will not respond, resulting in a default judgment in my favor. The clerk will then issue a letter instructing the title office to issue me a title for the yellow Cruising Wagon. Then I get a title and life is somewhat better, even if I'm somewhat poorer for the experience. The retainer from the attorney is $500, out of which $200 will go for the filing fee. But it will get done after all so that isn't such a bad thing. When it is all said and done I will be listing the car for sale.
